In light of the statutory provisions, the court was required to consider the applicable mandatory minimum sentence. On behalf of the defendant, submissions were made addressing his young age, significant mental health difficulties, and the impact of a substantial delay in the proceedings.
Having considered those matters, the court found that exceptional circumstances were established. The defendant was sentenced to two years’ imprisonment, substantially below the mandatory minimum that would otherwise have applied.
